TERMS OF SERVICE (TOS)

1. Introduction

These Terms of Service (“Terms”) govern your use of the services provided by TechPlus, including domain registration, web hosting, website design, software development, and related digital services. By using our services, you agree to these Terms, our Privacy Policy, and Acceptable Use Policy.

If you do not agree, you must not use our services.

2. Definitions

Client / Customer – Any individual or business receiving services from TechPlus. Company / Provider – TechPlus, Lahore, Pakistan. Services – Domain registration, hosting, design, development, and all related offerings. Content – Any data, files, website content, images, code, or material uploaded to our systems.

3. Domain Registration Terms

  1. All .PK domains are governed by PKNIC domain registration policies.
  2. All generic TLDs (.com, .net, .org etc.) follow ICANN regulations.
  3. Domain registration is subject to availability and cannot be guaranteed until payment is confirmed.
  4. Domain fees are non-refundable.
  5. Failure to renew before expiry may result in permanent loss of the domain.
  6. Customer is responsible for providing accurate registrant information.

4. Web Hosting Terms

  1. Hosting accounts are provided on a best-effort uptime basis.

  2. The company is not responsible for data loss resulting from client actions, malware, or misuse.

  3. Unlimited resources (bandwidth, storage, emails) are subject to fair-usage limits.

  4. Hosting may not be used for:

    • Adult/porn sites
    • Gambling/betting
    • Fraud, phishing, spam
    • Malware or illegal downloads
    • Religious or political extremism
    • Anything prohibited by PECA 2016 or PTA rules

  5. Violations may result in immediate account suspension without refund.

5. Website Design & Development Terms

  1. All design work requires 50% advance payment unless agreed otherwise.

  2. Project timelines are estimates; delays may occur based on client feedback.

  3. The client must provide content, logos, images, and requirements in a timely manner.

  4. After project delivery, any extra feature/change is charged separately.

  5. Source code ownership:

    • For custom development: ownership transfers upon full payment.
    • For CMS-based sites: plugins/themes remain under original license terms.

6. Payment & Billing

  1. All prices are quoted in PKR (or USD on request).

  2. Hosting and domain renewals must be paid before expiration.

  3. Late payments may result in account suspension or deletion.

  4. There are no refunds for:

    • Domain registration
    • Domain transfer
    • Hosting plans
    • Digital services already delivered

  5. Refunds for design/development are at the company’s discretion and depend on work completed.

7. Data Backup & Security

  1. Backups are taken periodically, but clients are responsible for maintaining their own backups.

  2. The company is not liable for:

    • Data loss
    • Hacking
    • Server failures
    • Client negligence

  3. Clients must use strong passwords and secure their applications.

8. Acceptable Use Policy (AUP)

Clients may NOT use our services for:

  • Hacking, phishing, scamming
  • Hosting cracked software, nulled scripts, torrents
  • Illegal political activity
  • Distribution of copyrighted material
  • Sending spam or mass unsolicited emails
  • Any activity violating Laws of Pakistan
  • Hosting harmful content or malware

Violation may result in immediate termination without refund.

9. Limitation of Liability

To the maximum extent allowed by law:

  • The company is not liable for indirect, incidental, or consequential damages.
  • Service is provided “as-is” without guarantees.
  • Maximum liability for any claim is limited to the amount paid in the last 30 days.

10. Suspension & Termination

We may suspend or terminate accounts for:

  • Non-payment
  • Abuse or AUP violations
  • Illegal use
  • Security threats
  • Chargebacks or disputes

Termination does not remove the client’s obligation to pay outstanding invoices.

11. Confidentiality

Both parties agree to keep project information confidential unless legally required.

12. Governing Law

These Terms are governed by the laws of Pakistan, including:

  • Pakistan Electronic Crimes Act (PECA 2016)
  • Pakistan Telecommunication Authority (PTA) regulations
  • The Contract Act, 1872

Disputes will be resolved in the courts of Lahore, Punjab.

13. Changes to Terms

The company may update these terms at any time. Continued use of services means the client accepts the updated terms.
